Terms & Conditions for Email Marketing

Introduction 

Industrial Information Network - IINis a b2b E-commerce portal (mention relationship with SMEDA) designed specifically to cater to the online trading services that IIN is offering. Email-marketing means using digital technologies to help sell your goods or services.By using attractive, professional-email communications, SMEs can stay in regular touch with their clients and build strong customer relationships. It helps them keep customers and prospects coming back

IIN (hereinafter referred to as the "IIN") currently offers E-mail marketing services to users (hereinafter referred to as the "Client" or "You") who agree to abide by the following terms and conditions:

The Services

The Services shall be as described on the IIN website or other information/material that the IIN may provide you from time to time. IIN reserves the right to amend/improve/correct/discontinue either temporarily or permanently the services (or any part thereof) with or without notice and you agree that IIN shall not be liable to you or any third party for such modification or discontinuance.

Antispam Policy

IIN E-marketing services cannot be used for "does not allow unsolicited commercial emails (UCE)". For more details on UCE please see our Anti-Spam Policy.

Privacy Policy

E-marketing Services provided by IIN are subject without limitation to IIN’s Privacy Policy. You agree to comply with the terms of the Privacy Policy which may be amended from time to time. IIN may modify the terms of the Agreement and may discontinue or change any aspects of the Services, without any formal notification, at its sole discretion. By using the e-marketing services subsequent to the modifications of the services or the terms contained herein, you agree to be bound by such changes. Any changes to the services or the terms and conditions become effective upon those changes being made live on the www.iin.com.pk website.

Suspension of services

IIN can suspend its services at any time. If we terminate our services without cause, we will refund your package fee.

Payment

a) The Services are subject to package fees according to the payment plans as stated in the packages and shall be billed in advance according to the package selected by the Client. (Please indicate whether the payment is payable immediately or by a due date)
b) Payments can only be made by Demand Draft and there shall be no refund for fees paid in any event.
c) In the event that payment is not received, IIN shall suspend services until payment is received.

Cancellation Policy

You shall be responsible for canceling your package and IIN will offer no refund for your failure to cancel your Package. Failure to comply with this clause shall result in immediate termination of the services by the IIN including forfeiture of fees.

Duration

Time duration of email-marketing will be 72 hours. Email shot that is selected according to package will be send within 72 hours.IIN will give self generated report to its customer in which total numbers of emails sending status is defined.

Monitoring

a) IIN reserves the right to monitor the newsletters created by you, and the right to remove any content if it believes that such content is:

• in violation of any national or international laws;
• is excessively violent or contains harassing content or hate speech;
• exposes trade secrets or other confidential information of another person.
• is otherwise malicious, fraudulent, or may result in retaliation against IIN by offended recipients.

b) We may investigate reported or obvious violations of our policies or any third party complaints and take actions which may include issuing warnings, denying access to or suspending/ terminating our services.

Obligations of the Client

The Client agrees that:

i. The Client unconditionally acknowledges and shall comply with the terms and condition of this Agreement which may occasionally be changed or updated without any prior notice.

ii. Not to use false names or false identities or use the Services for the publication or linking to any unlawful material which may be obscene, defamatory or breaches the rights of any third parties.

iii. IIN will append an "unsubscribe" link to all outgoing email which will allow visitors to remove themselves from our mailing list.

iv. Promptly notify IIN of any change in the Client’s communication addresses.

v. NOT all messages sent through the Services shall be received by the intended recipients.

vi. IIN will append a "Powered by Industrial Information Network™" footer and link to www.iin.com.pk to all outgoing email.

vii. That the Client shall abide by all applicable laws, statutes and regulations.

Privacy

We are committed to protecting your privacy. IIN will not share any information you give us (such as email addresses, name, contact information, or images) with any other organization or person. Your information will not be shared with any other parties, unless required under applicable law, legal process or to enforce these conditions. IIN will not use your information for the purpose of sending unsolicited commercial e-mail.

Intellectual Property

IIN does not make any claims to the intellectual property rights of the content that you submit or make available for inclusion in the Services. This shall also have the effect of IIN claiming no responsibility for any content that you post/transmit/email or otherwise make available via its Services.

Indemnity

The Client agrees to fully indemnify and keep IIN, its affiliates, officers and employees fully indemnified from and against all actions, losses, damages, claims and expenses including but not limited to legal fees, arising from the Client’s breach of contract, misuse of the Services and/ or any claims from third parties.

Disclaimer of Warranties

The Client expressly agrees that the use of the Services pursuant to this Agreement and associated package plans shall be at its own risk. The Services shall be provided on an 'as is' and 'as available basis'. IIN expressly disclaims all warranties of all kind whether express or implied including but not limited to the following:

a) The Services will be uninterrupted, timely, secure or error free
b) The results that may be obtained from the use of the Services will be accurate or reliable.
c) Any material that may be downloaded or otherwise obtained through the use of the Services shall be done at your own discretion/risk and you shall be solely responsible for any loss of data or damage to your computer system by the use of the Services.

Termination

This Agreement shall be immediately terminated by the IIN in the event that:
 
a) The Client fails to make payments to the IIN due hereunder within 5 days.
b) The Client commits a material breach of the terms and conditions stated in this Agreement.
